TERMS AND CONDITIONS
The Terms and Conditions (the “Terms And Conditions”) are between AnclA Enterprise corporation ("AnclA", “Ancla”, “we”, “us” or “our”) and you as an end user of AnclA’s Website located at https://www.ancla.ca (the “Site” or the “Website”), and/or as a recipient of an AnclA Catalog or E-Flyer (the “Catalog” or the ”E-Flyer”, “EFlyer”).
AnclA may, at its sole discretion and for any reason, modify, supplement or amend these Terms and Conditions without any notice or liability to you or any other person, by posting revised Terms and conditions on the ancla.ca Website. Your continued use of the ancla.ca Website signifies your acceptance of such revised Terms and Conditions, so check back frequently to read the most recent version.
By accessing the Site, sending information to AnclA or ordering Products or services from AnclA (whether through the Site, E-Flyer or Catalog) you agree to be bound to the Terms and Conditions. Please read these terms and conditions of use carefully before using this Website. Your use of The Site is expressly conditioned on your acceptance without modification of the following Terms and Conditions, and by using The Site you signify your acceptance of these Terms and Conditions. If you do not agree with any term set forth in AnclA’s Terms and Conditions, your sole recourse is to discontinue your use of the Site, the E-Flyer and/or the Catalog.
All prices quoted are payable in Canadian Dollars and, unless otherwise stated, do not include shipping charges or taxes (GST, PST, QST or HST). The E-Flyer, Catalog and ancla.ca Website each offer limited-time sales values, and special buys. Regular prices shown are the prices at which the Products have been sold by AnclA as of the date of issuance indicated.
AnclA reserves the right to limit quantities; reject, correct, cancel or refuse orders, and to terminate accounts, at its discretion, including, without limitation, if AnclA believes that customer conduct violates applicable law or is harmful to the interest of AnclA.
Market conditions and competitive pressures may cause prices and availability to change without further notice. Although great care is taken in the production of the Site, Catalog and E-Flyer, typographical, illustrative or pricing errors may occur. We reserve the right to correct errors at any time.
Payment can be made by Visa, MasterCard, American Express and Discover credit cards and Paypal©.
For credit card payments, the shipping address for your order must match the billing address of your credit card.

Orders will be processed once payment has been received.
There is a $25 charge for any check returned NSF.
COD (Cash On Delivery) is not accepted.
If you need to change or cancel your order please do so the same day the order is placed before 4pm Eastern Standard Time (EST) by calling AnclA Enterprise Corporation at (866) 472-6252. After that all orders are subject to a 5% cancellation fee plus shipping and handling if your order has been shipped.
There are no refunds or exchange for personal care items. Due to the nature of personal care items and related matters of hygiene and public safety, all sales are final.
Please have your order number ready when you place your call. Do not e-mail us with a request, as e-mails may not be processed in sufficient time to effect a change to an order.
Cancellations will not be accepted for custom made or special orders once they are in production.
All products on the site are shipped to Canadian addresses only. AnclA does not ship to PO Boxes or Addresses associated with Parcel Forwarding Companies
All Products are shipped from our Mississauga, ON warehouse. Orders placed Monday to Friday between 9:00 am at 4:00 pm (EST) will be shipped the same day. Orders placed after 4:00pm (EST) will be shipped the next business day.
At AnclA, shipping and handling charges are based on the following:
- The delivery option you choose
- The weight, size and dimensions of your items
- Your shipping preferences
Customers can choose to have orders shipped via Canada Post or courier.
AnclA does not ship Internationally, nor to PO Boxes and Addresses associated with Parcel Forwarding Companies.

There are no refunds or exchange for personal care items. Due to the nature of personal care items and related matters of hygiene and public safety, all sales are final.
AnclA Enterprise Corporation will Refund or Exchange defective Products only. Incorrect orders will be corrected once received and verified by AnclA. The corrected orders will be sent out with no additional shipping charge.
1. Returned merchandise requires prior authorization and an explanation for the return. Please contact us prior to returning an item for a Return Authorization Number.
2. Claims for defective, damaged or incorrect goods must be made within 5 business days of receipt.
3. All merchandise must be in the original packaging and sealed cartons.
4. All returned goods must include a packing slip and must be shipped freight prepaid to:

5. Credit will be issued as follows:
a. Merchandise less than 15 days old will be issued 100% credit less shipping charges.
b. merchandise 16 – 30 days old will be issued 100% credit, less 25% restocking fee and shipping charges
c. Merchandise older than 30 days and custom orders are not. returnable for credit.
d. No cash refunds will be given.
Please thoroughly inspect all items for shipping damage before accepting delivery. If damage has occurred, you must note the extent of the damage on the freight bill and call us within 5 business days.
The Site is provided as a service to you and is intended to provide general information about AnclA and its Products or services. AnclA reserves the right to delete, modify, or supplement the content of the Site at any time for any reason without prior notification, and will use reasonable efforts to include up-to-date and accurate information on the Site.
Neither the ancla.ca Website nor its content may be, in whole or in part, copied, reproduced, republished, uploaded, posted, transmitted or distributed without the written permission of AnclA Enterprise Corporation, except that you may download, display and print the content presented on ancla.ca for your personal, non-commercial use only. Unauthorized use of the ancla.ca Website and/or the content contained on ancla.ca may violate applicable copyright, trademark or other intellectual property laws or other laws. You must retain all copyright and trademark notices, including any other proprietary notices, contained within the content on this Website. The use of such content on any other Website or in any environment of networked computers is prohibited.
You are prohibited from contributing, posting or transmitting to this Website any infringing, unlawful, threatening, libelous, defamatory, obscene, indecent, inflammatory, pornographic or profane content or content that could constitute or encourage conduct that would be considered a criminal offence, give rise to civil liability, or otherwise violate any law.
In its sole discretion, in addition to any other rights or remedies available to AnclA Enterprise Corporation and without any liability whatsoever, AnclA at any time and without notice may terminate or restrict your access to any component of the Website.
In addition to other prohibitions as set forth in the Terms and Conditions, you are prohibited from using the Site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Site, E-Flyer, Catalog or of any related website (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Site, E-Flyer, Catalog or any related website. We reserve the right to terminate your use of the Site for violating any of the prohibited uses.
Your ancla.ca Website account may be accessed only by use of your login username and password. You are solely responsible and liable for any use and misuse of your login username and password and for all activities that occur under your login username and password. For security reasons, you must keep your login username and password confidential and not disclose them to any person or permit any other person to use them. AnclA recommends that you choose a password that is unique to you and not easily guessed by others. You should change your password on a regular basis, and you must log out at the end of each session.
AnclA Enterprise Corporation will never ask for your login username and password in an email, text message, pop-up or on social media.
Do not respond to text messages, emails, pop-ups or other Internet requests asking you for your Credentials or other personal information (even if such messages appear to be from AnclA)
You must immediately notify AnclA of any unauthorized use of your login username or password, or if you know or suspect that your login username or password has been lost or stolen, has become known to any other person, or has been otherwise compromised by calling (866) 472-6252
All login names and passwords remain the property of AnclA, and may be cancelled or suspended at any time by AnclA without any notice or liability to you or any other person. AnclA is not under any obligation to verify the actual identity or authority of the user of any login username or password.
Any links or references to other Internet Sites (“Hyperlinks”) contained on the Site are provided by AnclA merely as a convenience to users of the Site. The inclusion of any link does not imply endorsement, investigation or verification by AnclA or the Third Parties of the linked Website or information contained therein or of their security or privacy practices. AnclA and the Third Parties shall not be responsible for the content of any other linked Websites and makes no representation or warranty regarding any other Websites or the contents on such Websites. The Trademarks on the Site are protected by the laws of Canada and International trademark laws of other countries foreign to Canada. AnclA’s website, its design, all text, graphics, content, video, audio and the selection and arrangement thereof are the property of AnclA Enterprise Corporation, and/or its various subsidiaries, affiliates, third party providers and distributors (“Third Parties”), and are protected under the copyright laws of Canada and other countries. None of the content found on AnclA’s Website may be reproduced, republished, distributed, displayed, sold, transferred, or modified without the express written permission of AnclA Enterprise Corporation and/or the applicable Third Parties.
No confidential relationship shall be established in the event that you make any oral, written, or electronic response to AnclA (e.g. feedback, questions, comments, suggestions or ideas). AnclA shall be free to reproduce, publish or otherwise use such information including any ideas, inventions, concepts, techniques or know-how disclosed therein, for any purpose including developing, manufacturing and/or marketing of goods or services. The sender of any information to AnclA is fully responsible for its content, including its truthfulness and accuracy.
Please review our privacy policy so that you understand our privacy practices, the information we collect about you during your visit and what we do with that information, as it governs your visit to the Website.
AnclA collects personal information that you provide to us voluntarily, for example by placing an order for Products via the Site, Catalog or by completing a survey or user registration form, or responding to our E-Flyer. Such personal information may include your name, company name, e-mail address and/or phone number, and with respect to purchases, your shipping address and billing information. Survey’s may ask for demographical information such as age, gender, family size, etc. We will only use this information for the purposes for which you provided it to AnclA, and with your approval, on a regular basis we will send you an E-Flyer about our new Products. You can unsubscribe from this service at any time, either through the Site or from a link on the E-Flyer, or by e-mailing AnclA at the address provided on the “Contact Us” page.
When you submit your personally identifiable information on this Website, you are giving your consent to the collection, use and disclosure of your personal information as set forth in this Privacy Policy. If you would prefer that we not collect any personally identifiable information from you, please do not provide us with any such information.
AnclA also collects anonymous information from all visitors to the Site, such as IP addresses and aggregated site metrics, to generate statistics, develop marketing plans and improve the overall performance of the Site. In addition we may use IP addresses to analyze trends, administer our Website, track traffic patterns, and gather demographic information for aggregate use, as well as for credit fraud protection and risk reduction. Except as otherwise disclosed in this Privacy Policy, we will not use IP addresses in combination with your personally identifiable information without your prior consent.
AnclA does not share your contact information with any other third party without your consent, except to a court or governmental agency if required by law, as required by a court of competent jurisdiction, or to Third Parties it engages to provide services that involve data processing on its behalf. Such Third Parties do not include advertisers or marketers that would contact or solicit you. For example, AnclA engages a third party to fill product orders or coordinate mailings, and will disclose billing information to such Third Parties only as necessary for them to perform their function. In addition, AnclA works with agencies in order to administer AnclA’s E-Flyer distribution. AnclA will only disclose personal information to such Third Parties provided that they adhere to the same restrictions regarding use of your personal information as are set forth in the Terms and Conditions.
All personal data you submit to AnclA throughout the Site is encrypted with secure server software (SSL) that encodes the information before your Web browser software sends it to AnclA. The SSL software decodes the data only after it reaches AnclA’s server, meaning that your data will be encrypted were hackers try to intercept it while in transit. Once the data reaches AnclA’s server, your personal data will be protected by the same security software AnclA uses to guard all of its essential business data.
“Cookies” are small pieces of information that some Websites store on your computer’s hard drive when you visit them. The credit card information you enter into the sample form and order form is secure as they are designed to meet or exceed the vulnerability audit requirements of all credit card companies. However, it is impossible to guarantee the security of information you disclose online from a sufficiently powerful attack from unauthorized Third Parties.
AnclA disclaims and excludes all warranties and representations, express, implied or statutory, with respect to the Site, the Catalog, the E-Flyer, the Products and AnclA’s services, or with respect to the accuracy, currency or completeness of the information provided by AnclA, including the implied warranties of merchantability, fitness for a particular purpose and non-infringement of a patent, trademark or other intellectual property right.
Not withstanding any oral or written information, opinions, evaluations, Catalog descriptions or consultations of any kind furnished by AnclA, you specifically agree that it is your sole responsibility to select and evaluate the correct Products for use in your applications.
In no event shall AnclA be liable to you or to any third party for any direct, incidental, indirect, special or consequential damages whatsoever (including but not limited to, lost profits, business interruption, loss of programs or other data on your information system, even if AnclA has been advised, knew, or should have known of the possibility of such damages, arising out of or related to (i) your use of or reliance on the Site, the Catalog, the E-Flyer, or any information, hyperlinks or content contained therein, (ii) your provision of information, personal or otherwise, to AnclA, (iii) the provision of Products or services by AnclA, (iv) acts or negligence on the part of AnclA, its agents or employees, or (v) your use of any Products. In purchasing Products or services from AnclA, you expressly release and discharge AnclA from all such causes of action or damages. Without limiting the foregoing, in no event shall AnclA be liable to you for more than the purchase price of any Product purchased by you from AnclA.
The relationship between AnclA and you will be that of independent contractors, and neither of us nor any of our respective officers, agents or employees will be held or construed to be partners, joint ventures, fiduciaries, employees or agents of the other as a result of these Terms and Conditions or your use of the Site.
The Site, Catalog and E-Flyer, including, without limitation, all content, information and links contained therein, are provided “as-is” without any warranty that they will be uninterrupted or error-free.
You agree to indemnify and save harmless AnclA and any of our Third Parties and their respective officers, directors, employees, consultants, representatives and agents from and against any loss, damages, claim, cause of action or demand, including without limitation reasonable legal, accounting and other professional fees, brought as a result of your use of the Site.
This agreement and its performance shall be governed by the laws of the Province of Ontario, Canada. You consent and submit to the exclusive jurisdiction of the courts located in the City of Toronto, in the Province of Ontario, Canada, in all disputes arising out of or relating to your use of the Site and these Terms and Conditions.
